<title>You Tube Court Ruling</title>

<description><![CDATA[Is there an expectation of privacy on the Internet?  <br />

Today, a federal judge ruled that Viacom (who owns the rights to innumerable television programs) is entitled to the IP addresses and user names of those who watched copywrited material on YouTube.  Viacom (whose dwindling revenues follow on the heels of a downtrend in network television viewing) aims to obtain significant actual and potential punitive damages from YouTube for violation of copywrite.  The question remains whether the data which is being requested will ultimately lead to lawsuits against YouTube users.  Why would we think that to be the case?  Well, damage information as to the degree of damages which could be awarded to Viacom can be obtained based on the sheer numbers, rather than on personalized individual information.  Anonymity can be protected.  Yet, Viacom aims to obtain their "just reward" in unpaid revenues from YouTube at the expense of setting a dangerous precedent.<br />
<br />
What is a precedent?  From a legal standpoint, a precedent is a case which serves as a go-by in subsequent cases.  Often, a precedent will be small and then end up carving out an entire new avenue of laws that expand the scope of the initial case in application as well as ramification.  <br />
<br />
What does this technology lawsuit mean to you?  You know you thought it too.  You use a site to upload videos and the potential risk to you is nil, as you have a made up user name.  Now, with this ruling, it is possible that a company could obtain payment from you (Mr. and Mrs. Smith) by simply petitioning the court for your identifying information.  Using your IP address, your internet provider can be identified, and the viola your anonymity is nonexistent.  Is this the harbringer of a curtailing of Internet sharing?  Your guess is as good as mine, but we should all be concerned.  Ironic isn't it, that such a ruling should come the day before the 4th of July when we celebrate our independence including our right to privacy which is slowly being erroded.  ]]></description>

Notes from the meeting last night at the Sports Club in HC: <br />
<br />
1. Police officers from both counties were present and we spent the majority of the time talking about security issues. From the abundance of information they reported in terms of the types of incidents that have been reported, there are 3 issues (one is a big issue and the other 2 are preventable). July, August, and December are the busiest months for this type of activity but we have a serious on-going problem right now: <br />
<br />
Type 1 (IMPORTANT):There is a big problem right now within the University Area (this is not restricted to HC) where several groups of young black males are driving up to houses, knocking on the front door, and kicking the front door in to raid the house if no one answers.  This typically occurs between 9AM and 2PM and they steal everything from cash, TVs, guns, ect.  Between Dec 14 and Jan 13 alone, there were 62 of these incidents (a record number for one month) in just Meck. Co. and they continue to occur.  If they can get through the front door, they will just go to the back.  While I am concerned about protecting my property, I am more concerned about individuals like myself who are sometimes at home working alone but dont typically answer my door for safety reasons (especially moms with young kids), and for those who leave pets at home alone during the day.  It does not appear that they are looking to hurt anyone (at least yet) so they may run if they come in and see someone but you dont know when that line will be crossed.  There are very few things that will deter these people.  They have broken in to houses with alarms and dogs, for example.  Keep in mind that an alarm does not get someone to your house immediately so they are done with your house before anyone knows it and if you have a small dog that barks and no one comes to the door, that is just a stronger indication that no one is home so they will go in.  It is because of this problem that WE MUST START A COMMUNITY WATCH TO HELP EACH OTHER!  Other than somehow making it look like someone is home during the day if you can, THERE IS NO OTHER LINE OF DEFENSE.  I will talk about community watches below.   <br />
Type 2 (Preventable):  Car  break -ins (Dont keep valuables in your car) and car theft (keep your car in your garage at night). <br />
Type 3 (Preventable):  Dont keep your garages open.  Lots of golf clubs have been stolen out of open garages during the day.  unless you are in it, keep it closed. <br />
<br />
Refer to my previous email about other safety measures you might want to consider.  In addition, you may want to think about installing inexpensive window and door alarms (they are just noise makers).  They sell them at Lowes and Home Depot.   <br />

It is important that we do the following as a community: <br />
Start and participate in the community watch program.  This program is only what the neighbors make it.  It is just neighbors looking after neighbors<br />
<br />
If you see anyone (that is not familiar to you in regards to living in your neighborhood) knocking on front doors in the middle of the day, call 911 immediately without exception.  It is unfortunate that we have to go to that extreme but it has gotten to that point.  Simply ask them to send an officer out immediately to check out a potential front door break-in and give them the address.  It is better to call them and have it be nothing that it is for someone to get hurt or their property stolen.   <br />
<br />
Carry a cell phone with you at all times so that if you are driving or walking through the neighborhood, you can call 911 if you see something.  WE NEED TO BE THE EYES AND EARS FOR THE POLICE.  They are doing the best they can but they need our help to catch them. <br />
<br />
Community Watch:  HC is attempting to get all 48 villages to start a neighborhood watch.  8 of those villages are on the Cabarrus side and will deal with the concord police dept.  In a nutshell, a NW program is simply  neighbors looking after neighbors There is really not any real work involved once it is set up.  You have a Chairperson that acts as a facilitator/organizer and then you have block captains that are responsible for keeping their street informed.  To get started, you need 25% of the neighborhood to sign up formally with the goal that you will shoot for at least 75% if not 100% eventually.  Once the organization is put in to place, they post signs in our neighborhood, a meeting with the community is scheduled with a police officer to kick off the program and learn more about safety, but other than that, it is just an information distributing program.  They recommend that we (as a community) schedule quarterly get-togethers to get to know our neighbors; you will help look after your neighbors if you know them better.  We would be in direct contact with the police department on a regular basis rather than hearing things second hand and would have some official help.  The goal is for all of us to be in the know and be the eyes and ears of our community.  We can only do that well if we have clear communication abilities.  There are several folks who have already emailed me to volunteer for the program so I am going to start forming a committee with the help of that small group but we need more volunteers.  If you have contacted me already, I will be contacting you in a separate email.  If you have not emailed me and can help, please email me ASAP and let me know whether you can be a block captain.  I would like to find several block captains for each street so that the real effort is minimal.  PLEASE HELP THE COMMUNITY.  As soon as I have gotten a group of volunteers to help lead this thing, I think we should meet briefly (30 minutes) as a group and get a plan together.  Again, it will take a little effort to get it initiated but once it is up and running, there is little to no work involved. <br />
<br />
On a completely different note, if you are renting your home, you are required to supply Hawthorne Management with a copy of your lease.   <br />
  <br />
 HC is holding stable even with the bad market right now.  The number of foreclosures has not really fluctuated like it has in other neighborhoods. <br />
  <br />
 If you know of anything in the entire HC area that needs fixed, let m know. <br />
  <br />
The board is generating their priority list right now for community improvement projects.  A few mentioned:  there has been a lot of work to improve lighting and there will be 2-3 more wells drilled in the near future.  They will hopefully be improving our entrance here in the back of the neighborhood as well.  I complained about that.  They do not have a lot of room to do much but are going to make it a bit more official (the one coming in on Ellenwood). <br />
